America has draft legislation in the works for #data #privacy and protection appropriately called the American Data Privacy and Protection Act or #ADPPA. Leading the way on ADPPA are Frank Pallone of New Jersey, Cathy McMorris Rodgers of Washington and Roger Wicker of Mississippi.
As stated in the opening line, “To provide consumers with foundational data privacy rights, create strong oversight mechanisms, and establish meaningful enforcement.” the ADPPA looks to set standards for a few necessary topics including:
- Privacy by design or duty of loyalty (to the consumer...)
- Consumer Data Rights (with a section on #Web3 style data #ownership and #child #protection)
- Corporate Accountability
- Enforcement by the Federal Trade Commission (FTC)
A forward thinking, comprehensive draft #legislation indeed with many challenges that are tough to get on paper but these brave lawmakers managed to get it done.
“This bipartisan and bicameral effort to produce a comprehensive data privacy framework has been years in the making, and the release of this discussion draft represents a critical milestone,”
“In the coming weeks, we will be working with our colleagues on both sides of the aisle to build support and finalize this standard to give Americans more control over their personal data. This landmark agreement represents the sum of years of good faith efforts by us, other Members, and numerous stakeholders as we work together to provide American consumers with comprehensive data privacy protections.”
“We believe strongly that this standard represents the best opportunity to pass a federal data privacy law in decades, and we look forward to continuing to work together to get this bill finalized and signed into law soon.”
No one wants more rules but in this case, this work is necessary to combat not only protection for consumers but the enormous liability #tech companies face without legislation. Setting ground rules for how data is captured, who owns it and how children interact with it are a natural evolution to how we approach our everyday lives. Look forward to watching this evolve.
